Anatomy of a Grievance
All grievance must contain three essential elements: 1. Something must have happened, 2. The something must be a violation of the Collective Bargaining Agreement (contract), the Chancellor's Regulations or the By-Laws of the Board of Education, and 3. There must be a remedy available.
In order to file a grievance, you must be the aggrieved party and you must adhere to the contractual timeframes to file the grievance. The responsibility to file the grievance is the member's but in most cases the Chapter Leader will assist in you filing the grievance. You should keep copies of your filed grievance and all supporting documents relevant to your grievance. You should notify your Chapter Leader of any grievances you have filed so he/she may notify the District Representative especially if you think the grievance might need to be heard at the next level.
Remember to cite the correct Articles violated from the correct contract. You should always include the article of your contract called "Matters Not Covered". If you are unsure as to the articles violated , please ask your Chapter Leader or call the Borough Office for advice.
